Terms & Conditions
Please read these terms and conditions carefully before using our services. By accessing or using The Chase Hub, you agree to be bound by these terms.
1. Eligibility
- Age: You must be at least 18 years old to use our services or enter any giveaways.
- Residency: Our services (including giveaways) are currently available to residents of Australia. We may allow international customers for shop purchases, but our giveaways and membership perks are intended for Australian users due to local regulations.
- One Account Per Person: You may not create multiple memberships/accounts for the same person to gain additional entries or benefits unfairly.
- Fair Play: Employees of The Chase Hub, our affiliates, and their immediate family members cannot participate in our giveaways to keep things fair. (Immediate family generally includes spouses, parents, children, or anyone living in the same household of those employees.)
2. Membership & Subscriptions
The Chase Hub offers optional membership subscriptions that provide access to exclusive perks:
- Membership Perks: As a member, you get automatic entries into our giveaways, as well as discounts in our shop or with partners, and other perks. These entries are included as a bonus with your membership; you are not buying individual raffle tickets. (Australian trade promotion laws require that entries be tied to genuine membership benefits, not sold separately.)
- Subscription Plans: We may offer different membership tiers (for example, a Basic or Premium plan). Higher tiers might include more entries or bigger discounts as part of the package. We will clearly explain what each tier provides before you sign up.
- Billing: Memberships are billed on a recurring basis (e.g. monthly). By signing up, you authorize us to charge your provided payment method at the start of each billing cycle until you cancel. We will display the price and billing interval during sign-up so there are no surprises.
- Cancellation: You can cancel your subscription at any time through your account settings or by contacting us. Cancellation will stop future billing, but we do not provide refunds for the remainder of a period you've already paid for, unless required by law (see Refunds section below). Your membership benefits will continue until the end of the paid period, then not renew.
- No Refunds for Change of Mind: If you choose to cancel partway through a paid period or decide the membership isn't for you, we typically do not offer a refund for the current billing cycle. However, if The Chase Hub fails to deliver the services or perks promised with your membership, you may be entitled to a refund or other remedy as required by Australian Consumer Law.
- Account Use: Membership is personal to you. Please do not share your login or membership benefits with others. If we detect abuse (such as someone sharing their member-only discount codes publicly or transferring entries to others), we reserve the right to suspend or cancel the membership.
- Changes to Membership: We may adjust the membership offerings occasionally (for example, adding new perks or changing entry allocations). Any material changes to what you're entitled to will be communicated to you, and if you don't agree with the changes, you can cancel before your next renewal.
3. Giveaways & Competitions
We run prize giveaways (competitions) to thank and reward our community. These may be referred to as giveaways, raffles, or trade promotions:
- How to Enter: Typically, active members are automatically entered into our regular giveaways. Sometimes we might run special contests or promotions with separate entry methods (like filling out a form or performing an action). If so, we'll always explain clearly how to enter, the opening/closing dates, and any specific rules in the promotion details.
- No Purchase of Entries: You cannot directly purchase entries into our prize draws. Entries are earned via membership or via specified free methods (if offered) in compliance with Australian trade promotion laws. In other words, we don't sell raffle tickets outright; entry comes as a bonus or reward for being part of The Chase Hub community.
- Game of Chance: Unless we state otherwise, our giveaways are games of chance, meaning winners are selected randomly and skill plays no part in determining the winner. Every eligible entry has an equal chance of winning.
- No Guaranteed Wins: Having a membership or entries gives you a chance to win, but it does not guarantee you will win a prize. We want to be clear that winning is never assured – only a small number of entrants will win in any draw, and the rest will not.
- Odds of Winning: The odds of winning any giveaway depend on the total number of entries received for that draw. We can't provide an exact probability because it varies based on participation.
- Fair Draws: We conduct all draws fairly and transparently. Winners are usually drawn via a computer-generated random selection or another method of chance. We do not allow any favoritism or "insider" advantage.
- Winner Notification: If you win, we will contact you via the contact information you provided (such as email or phone). We may also announce winners on our website, social media, or other public channels.
- Claiming Prizes: Winners must claim their prize within a specified timeframe. When we notify you, we'll include any steps needed to verify and claim (such as proving your identity/eligibility) and the deadline to respond.
- Prize Delivery: Physical prizes (like merchandise or cards) will be sent to the winner's provided address at our expense. Virtual prizes (like digital gift cards or memberships) will be emailed.
- Member Giveaways & Legal Compliance: Our giveaways are intended to comply with Australian trade promotion laws. In Australia, certain prize draws (especially high-value ones) require permits or authority in some states.
- Accuracy & Transparency: We promise to accurately represent our giveaways and prizes. The Australian Consumer Law (ACL) prohibits misleading or deceptive conduct, so we will never deceive you about the nature of a giveaway or the prizes on offer.
4. In-House Card Restoration Services
We offer card restoration services to help improve the condition of your trading cards (for example, cleaning, flattening, or minor repairs to Pokémon or other TCG cards). By using our restoration services, you agree to the following terms:
- Service Description: When you submit a card for restoration, we will discuss and confirm with you what services will be performed (e.g., removing surface dirt, smoothing a crease, recoloring edges, etc.). We will only proceed with techniques that you approve. All restoration work is done in-house by experienced staff who understand collectibles.
- Best Effort (No Perfection Guaranteed): Our team will handle your cards with great care and use professional techniques to improve their condition. However, we cannot guarantee specific results or that a card will achieve a certain grading or value after restoration.
- Inherent Risks: By using our restoration services, you acknowledge that there are some risks involved. For example, a cleaning solvent that works well on most cards might react unexpectedly on your card, or attempting to flatten a crease could cause a small crack if the card stock is brittle.
- Limit of Liability for Restoration: We are not liable for minor or negligible changes that might occur as a side effect of a restoration process, provided we exercised due care. If we damage your card significantly beyond the agreed-upon work, we will compensate you fairly.
- Customer Responsibilities: You should only submit cards that you own and have the right to have restored. It's your responsibility to pack and ship the card to us safely if you mail it.
- Results & Satisfaction: After the service, we'll show you what was done (through photos or in person) and which issues were improved. Most customers are happy with the outcome, but if you feel that the result is not what was promised, please tell us.
- Restoration Ethics: We restore cards to preserve and enhance your enjoyment of them, not to deceive others. We do not participate in or condone altering cards in a way that misrepresents their true condition.
5. In-House Shop Purchases (Trading Cards & Accessories)
When you buy products from The Chase Hub's shop (either through our website or in our physical location, if we have one), the following terms apply:
- Product Information: We strive to provide accurate descriptions and images of all products, including the condition of individual trading cards (using standard grading terms if applicable) and details of accessories or merchandise.
- Pricing: All prices are listed in Australian Dollars (AUD) and include GST (Goods and Services Tax) where applicable, unless stated otherwise.
- Payment: Payment is due at the time of order. We accept common payment methods (e.g., Visa, MasterCard, PayPal, etc.).
- Order Confirmation: Once you place an order, you should receive an order confirmation via email. This confirms we got your order.
- Shipping & Delivery: We will ship physical products to the address you provide. During checkout, you'll see shipping options or fees (if any). We generally ship within 2 business days of receiving an order.
- Title and Risk: Ownership of products passes to you once we have received full payment and the product is dispatched to you.
- Returns for Change of Mind: We do not automatically accept returns if you simply change your mind or ordered the wrong item. Under consumer law, you're not entitled to a refund for changing your mind.
- Faulty or Incorrect Products: If the product you received is faulty, damaged (beyond minor packaging dings), or not what you ordered, please let us know as soon as possible. You are entitled to a remedy under Australian Consumer Law when goods have a major problem or don't match their description.
- Pre-Orders: If you pre-order an item (for example, a new card set release), we will charge you at the time of order (unless stated otherwise) and reserve the item for you.
- Backorders: If an item is unexpectedly out of stock or on backorder after you ordered, we will inform you. You can either wait for restock or receive a full refund – your choice.
6. Partner Discounts & Affiliate Offers
We partner with other businesses to give our members special discounts or offers. Here's how these work:
- How Partner Offers Work: We will let members know about current partner deals, either on our website in a members' area or via email/newsletter.
- Third-Party Terms: Any goods or services you obtain from a partner are ultimately provided by that third-party partner, not by The Chase Hub.
- Availability and Changes: Partner offers are usually time-limited or subject to availability. We'll try to provide the valid dates or any important conditions of each offer.
- No Endorsement Guarantee: We select partners that we believe will be valuable to our members. However, The Chase Hub doesn't guarantee or take responsibility for the products/services provided by partner companies.
- Liability: Because partner offers are fulfilled by the partner, The Chase Hub isn't liable for anything that happens in those transactions.
- Misuse of Partner Offers: Member-exclusive deals are meant for genuine use by members. Abuse of partner offers can result in the partner refusing the discount and possibly ending the offer for everyone.
7. Refunds, Cancellations, and Consumer Guarantees
We've touched on refunds and cancellations in various sections above, but here is a summary of our policies and, importantly, your rights under Australian law:
- Membership Cancellations: When you cancel your membership, we generally don't offer a refund for any remaining days in your current billing period (unless required by law).
- Product Refunds/Returns: As explained in the Shop section, we comply with the consumer guarantees under Australian Consumer Law.
- Service Issues: For our services (like card restoration or any other service we provide), similar principles apply.
- Process for Claims: To seek a refund, replacement, or any remedy, the best channel is to contact our customer support.
- Your Statutory Rights: Nothing in these Terms is meant to reduce or take away your rights under Australian Consumer Law.
8. Limitation of Liability & Disclaimers
We believe in being fair and accountable, but we do need to set some reasonable limits on what we're responsible for in using our services:
- General Service Provision: The Chase Hub provides its website, membership, and services on an "as is" and "as available" basis.
- External Factors: We are not responsible for things outside our control. This includes issues like: delays or failures by our suppliers or partners, internet outages, natural disasters affecting our operations, or shipping delays caused by postal services.
- No Guaranteed Outcomes: We don't guarantee any particular outcome from using our services.
- Indirect or Consequential Loss: To the maximum extent permitted by law, The Chase Hub will not be liable for indirect, incidental, special, or consequential losses.
- Liability Cap: In any case where we are found liable to you, our liability is limited to the repair, replacement, or cost of re-supplying the goods or services in question.
- No Waiver of Legal Rights: Nothing in these Terms is intended to exclude or restrict rights you have under law. Australian Consumer Law, in particular, gives consumers non-excludable rights and remedies.
9. Changes to These Terms
- Updates: We may update or change these Terms & Conditions from time to time. Reasons for changes could include accommodating new services or features, changes in the law, or improvements in clarity.
- Acceptance of Changes: If you continue to use The Chase Hub services or maintain your membership after a Terms update, that will indicate acceptance of the new Terms.
- Version Consistency: These Terms & Conditions apply as a whole agreement between you and us regarding your use of The Chase Hub.
- Severability: If a court or regulator decides that any part of these Terms is invalid or unenforceable, the rest of the Terms shall continue to apply as normal.
